1. Acceptance of Terms
By downloading, installing, or using SystemMax Optimizer ("Software", "Service"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not use our services.
2. License Grant
SystemMax Software grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Software strictly in accordance with the terms of this Agreement and your selected subscription plan (e.g., 1 Device, 3 Devices).
Restrictions: You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, distribute, or commercially exploit the Software.
- Modify, make derivative works of, disassemble, decrypt, or reverse engineer any part of the Software.
- Share your activation key with third parties outside of your allowed device limit.
3. Subscriptions and Billing
SystemMax Optimizer is offered on a subscription basis (Monthly, 3-Month, 6-Month, or Yearly). By purchasing a subscription, you authorize us (and our third-party payment processors like Stripe/PayPal) to charge your payment method on a recurring basis.
You may cancel your subscription at any time through your client portal or by contacting our support team. Cancellation will stop future charges, but your license will remain active until the end of the current billing cycle.
4. Refund Policy
We offer a 7-Day Money-Back Guarantee. If you are not completely satisfied with the Software's performance, you may request a full refund within 7 days of your initial purchase by contacting us at our support email. After 7 days, all sales are final.
5. Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. While we strive for maximum optimization and network stability, SystemMax Software does not guarantee that the Software will meet your specific requirements, or that its operation will be uninterrupted or error-free. Use of the Software is at your own risk.
6. Limitation of Liability
In no event shall SystemMax Software be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data or profit, arising out of the use or the inability to use the Software, even if we have been advised of the possibility of such damages.
